How Foreclosure Works in Georgia
Georgia is what’s known as a non-judicial foreclosure state. That means your lender doesn’t need to take you to court to foreclose. Instead, the process is carried out under the “power of sale” clause in your deed of trust or mortgage.
Here’s what happens:

Notice of Foreclosure Sale
By law, the lender must give you at least 30 days’ written notice before the property can be sold. That notice also has to be published in the county’s legal newspaper for four consecutive weeks. (O.C.G.A. § 44-14-162).

Auction
Sales are held on the first Tuesday of the month at the county courthouse, where the property is auctioned to the highest cash bidder.

Your Rights Before the Sale
You have the right to:
⦁ Reinstate your loan by paying all missed payments, penalties, and legal costs.
⦁ Redeem the property by paying off the balance in full before the sale is finalized.
